Nicherly is operated by South Arc Digital LLC ("we," "us," "our"). We provide a local business intelligence platform that helps digital marketing agencies identify prospective clients by analyzing publicly available business data from sources such as Google Business Profiles.

2. Information We Collect

2.1 Account Information

When you create an account, we collect your name, email address, and authentication credentials through our identity provider (Clerk). If you sign in with Google, we receive your name and email from your Google account. We do not access your Google contacts, calendar, or other data.

2.2 Payment Information

Payments are processed by Stripe. We never receive, store, or have access to your full credit card number. Stripe provides us with a transaction ID, payment amount, and the last four digits of your card for receipt purposes only.

2.3 Usage Data

We collect information about how you use Nicherly, including: which niches and cities you target, which prospects you unlock, audits you run, reports you generate, and features you interact with. This helps us improve the product and understand user needs.

2.4 Device and Log Data

We automatically collect technical information when you visit Nicherly, including your IP address, browser type, operating system, referring URL, pages visited, and timestamps. We use this for security, analytics, and to improve performance.

2.5 Business Data

Nicherly aggregates and analyzes publicly available information about local businesses from sources including Google Business Profiles, public websites, and business directories. This data includes business names, addresses, phone numbers, websites, reviews, and ratings — all of which are publicly accessible on the internet. We do not collect private or non-public business information.

3. How We Use Your Information

  • To provide and maintain the Nicherly platform
  • To process your payments and manage your subscription
  • To personalize your experience (e.g., showing prospects matching your preferred niches and cities)
  • To send transactional emails (welcome, receipts, account notifications)
  • To analyze usage patterns and improve the product
  • To detect and prevent fraud, abuse, and security incidents
  • To comply with legal obligations

We do not sell your personal information to third parties. We do not use your data for third-party advertising.

4. Cookies and Tracking

4.1 Essential Cookies

We use cookies that are strictly necessary for the platform to function. These include authentication session cookies (provided by Clerk) that keep you signed in. You cannot opt out of these cookies and continue using Nicherly.

4.2 Analytics Cookies

We use PostHog, a privacy-focused analytics tool, to understand how users interact with Nicherly. PostHog collects anonymized usage data including pages visited, features used, and general geographic location (country/region level). PostHog does not sell data to third parties. You can opt out of analytics cookies through your browser settings.

4.3 Local Storage

We use your browser's local storage to save your agency branding preferences (name, logo, colors) so they persist across sessions. This data stays on your device and is not transmitted to our servers unless you explicitly generate a report.

4.4 No Third-Party Advertising Cookies

We do not use advertising cookies, retargeting pixels, or any third-party tracking for ad purposes.

5. Data Sharing

We share your data only with the following service providers, solely to operate Nicherly:

  • Clerk — Authentication and identity management
  • Stripe — Payment processing
  • Railway — Cloud hosting infrastructure
  • Resend — Transactional email delivery
  • Google (Gemini API) — AI-powered business analysis (we send business profile data, not your personal data)
  • PostHog — Product analytics

Each provider processes data under their own privacy policy and data processing agreements. We do not share your personal information with any other third parties.

6. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will delete your personal data within 30 days, except where we are required to retain it for legal, tax, or compliance purposes (up to 7 years for financial records).

Aggregated, anonymized usage data that cannot be linked back to you may be retained indefinitely for product improvement purposes.

7. Your Rights Under GDPR (EEA Residents)

If you are located in the European Economic Area, you have the right to:

  • Access — Request a copy of the personal data we hold about you
  • Rectification — Request correction of inaccurate data
  • Erasure — Request deletion of your data ("right to be forgotten")
  • Portability — Request your data in a machine-readable format
  • Restriction — Request that we limit processing of your data
  • Objection — Object to processing based on legitimate interests
  • Withdraw consent — Where processing is based on consent, withdraw it at any time

Legal basis for processing: We process your data based on (a) contractual necessity (to provide the service you signed up for), (b) legitimate interest (analytics and product improvement), and (c) consent (for optional analytics cookies).

8. Your Rights Under CCPA (California Residents)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with:

  • Right to Know — What personal information we collect and how we use it
  • Right to Delete — Request deletion of your personal information
  • Right to Opt-Out — Opt out of the sale of personal information (we do not sell your data)
  • Right to Non-Discrimination — We will not discriminate against you for exercising your rights

We do not sell personal information. We do not share personal information for cross-context behavioral advertising. To exercise your rights, email privacy@nicherly.comor submit a request through your account settings.

Categories of data collected in the last 12 months: Identifiers (name, email), commercial information (subscription plan, payment history), internet activity (usage data, pages visited), geolocation data (IP-based country/region).

9. Data Security

We implement industry-standard security measures including: encrypted data in transit (TLS/SSL), encrypted data at rest (database encryption), rate limiting on API endpoints, secure authentication via Clerk, and regular security reviews. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. International Data Transfers

Our servers are hosted in the United States and Singapore (via Railway). If you are accessing Nicherly from outside the United States, your data will be transferred to and processed in these locations. By using Nicherly, you consent to this transfer. We rely on Standard Contractual Clauses and service provider data processing agreements to protect international transfers.

11. Children's Privacy

Nicherly is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected data from a child, we will delete it promptly.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on Nicherly. Your continued use of the platform after changes are posted constitutes acceptance of the updated policy.
